The internal regulations applicable to vocational training trainees. They are sent to trainees along with their convocation pack.
Article 1:
Pursuant to the provisions of Article L6352-3 of the French Labor Code and by virtue of its general and collective regulatory authority, CALIOPSY's management hereby sets forth the following:
- General and permanent rules governing discipline
- Measures to enforce health and safety regulations
In accordance with the principles set out in Article L6352-4 of the French Labor Code, it also defines the nature and scale of sanctions that may be applied in the event of failure to comply with the aforementioned rules, and sets out the provisions relating to the rights of defense that must accompany the implementation of such sanctions.
The rules set out in these internal regulations apply to all trainees on each course.
Article 2: Discipline
During the internship, trainees must endeavor to behave in a professional manner, refraining from any absences from the internship other than during agreed breaks or as required by the internship.
Training hours are set by the training organization. Trainees are required to respect these schedules scrupulously, on pain of disciplinary action.
CALIOPSY management must be notified by any means as soon as an absence begins.
All foreseeable absences for personal reasons must be authorized in advance by CALIOPSY management.
All absences must be made up.
Trainees are strictly forbidden to:
- Bringing alcoholic beverages onto the organization's premises;
- To attend training courses while intoxicated;
- to eat in the classrooms;
- to use their cell phones during sessions;
Article 3: Penalties
Depending on the nature and seriousness of the misconduct, the management of the training organization may impose one or other of the following sanctions, in ascending order of importance:
- Written warning from the Director of the training organization ;
- Blame
Article 4 Pre-sanction interview and procedure
No sanction may be imposed on a trainee without the latter being informed at the same time, in writing, of the grievances against him/her. When the training organization is considering imposing a sanction, it summons the trainee by registered letter with acknowledgement of receipt, or by hand-delivered against receipt, indicating the purpose of the summons and the date, time and place of the meeting, unless the proposed sanction does not affect the trainee's attendance for the remainder of the training course.
During the interview, the trainee may be assisted by a person of his/her choice, either a trainee or an employee of the training organization. The summons referred to in the previous article shall mention this option. During the interview, the reason for the envisaged sanction is indicated to the trainee, who is then given the opportunity to give any explanation or justification for the facts of which he or she is accused.
When the training organization considers a temporary exclusion with immediate effect to be essential, no definitive sanction relating to the misconduct which led to the exclusion may be taken without the trainee having first been informed of the grievances against him/her and, if applicable, having been summoned to an interview and given the opportunity to explain himself/herself before a Disciplinary Committee.
Sanctions may not be imposed less than one clear day or more than 15 days after the interview or, where applicable, after the Disciplinary Committee has given its opinion.
The trainee is notified of the decision in writing, stating the reasons, by registered letter or by letter delivered against receipt. At the same time, the training organization informs the employer and, if applicable, the joint body paying the training costs, of the sanction taken.
Article 5: Trainee representation
When an internship lasts more than 500 hours, a full delegate and a deputy delegate are elected in a two-round uninominal ballot. All trainees are eligible to vote.
The training organization organizes the ballot, which takes place during training hours, no earlier than 20 hours and no later than 40 hours after the start of the course. Should it prove impossible to appoint trainees' representatives, the training organization will draw up a "procès-verbal de carence", which will be forwarded to the regional prefect with territorial jurisdiction.
Delegates are elected for the duration of the training course. Their functions end when they cease, for whatever reason, to participate in the training.
If the titular delegate and alternate delegate have ceased their functions before the end of the training session, a new election is held under the conditions set out in articles R.6352-9 to R.6352-12.
Trainee representatives make any suggestions they can to improve the running of training courses and trainees' living conditions within the training organization. They present all individual or collective complaints relating to these matters, to health and safety conditions and to the application of internal regulations.
Article 6: Health and safety
Preventing the risk of accidents and illness is imperative, and requires everyone to comply fully with all applicable health and safety regulations. To this end, the general and specific safety instructions in force within the organization, where they exist, must be strictly adhered to, on pain of disciplinary action.
In accordance with article R.6352-1 of the French Labor Code, when training takes place in an establishment that already has internal regulations, the health and safety measures applicable are those set out in the latter regulations.
When training takes place on the training organization's own premises, or on premises outside the training organization which do not have internal regulations, all the provisions of the present chapter shall apply.
